Our story so far...
After a two year court defence over arrests at a tent city in Victoria BC, sections of two city bylaws were declared unconstitutional and of no force in effect insofar as they prohibited homeless people from erecting temporary structure.
The city of Victoria, interpreting the judge's ruling as defining temporary as meaning overnight, drafted a bylaw enforcement policing to continue to prohibit homeless people from erecting temporary shelter from 7am to 7pm.
Arrests were made after a tent was set up under a Sequoia tree behind city hall on Oct.31.
Those charges were stayed by the Crown, who informed the city that their new enforcement policy was not likely to stand up to constitutional scrutiny either.
The campers were there for four days, with the city unsure how to move them. When the Downtown Victoria Business Association applied for a permit, the city told the media that this permit would supersede any other use of the park, and that the campers would be evicted to make room for a public lighting of Xmas lights on the tree.
The campers made an agreement to leave the area at 12pm, well before the DVBA's permit came into effect. This was communicated to the city, but the city decided to move in at 9am, arrest the campers under the unconstitutional bylaw enforcement policy, and seize all the camper's gear, even the gear they had removed from the area already.
The case is now going to civil court, regarding non-payment of the numerous $100 tickets issued...
